Toto the Rabbit
Terms of Use

These Terms of Use govern your access to the Toto the Rabbit website, early-access signup, and personalized children’s audio stories. By using Toto, you agree to these terms.
Who we are
Toto the Rabbit is an early-stage project for personalized children’s audio stories. When these terms say “Toto,” “we,” or “us,” they mean the operator of the Toto the Rabbit project.
Who may use Toto
Toto is offered to parents and caregivers who are at least 18 years old and able to enter into a binding agreement. Children may listen with a parent or caregiver, but should not submit information or use the service on their own.
Early access and availability
Toto is in early validation. Stories may be created or delivered manually, and features, delivery timing, availability, and pricing may change. We may modify, pause, or discontinue any part of the service, and we cannot promise that the service will always be available or error-free.
Your responsibilities
You are responsible for the information you submit and for deciding whether a story is appropriate for your child. Please provide only information you have the right to share, do not submit sensitive personal information, and supervise children while they use Toto. Toto is not medical, therapeutic, educational, or professional advice and is not a substitute for parental judgment.
Story details and feedback
You keep ownership of information, ideas, and feedback you submit. You give us permission to use submitted story details to create, personalize, deliver, and improve Toto, and to use feedback without restriction or payment. Our handling of personal information is explained in our Privacy Policy.
Ownership and permitted use
Toto’s website, stories, recordings, characters, artwork, branding, and other materials are owned by us or our licensors and are protected by applicable intellectual-property laws. We give you a limited, personal, non-exclusive, non-transferable right to listen to stories delivered to you for your family’s non-commercial use. You may not copy, sell, publicly distribute, modify, reverse engineer, or use Toto to create a competing service without our written permission.
Plans, payments, and cancellation
If you choose a paid plan, the price, trial period, billing frequency, automatic-renewal terms, and any additional conditions will be shown before you authorize payment. You may cancel future renewal using the method provided with the offer or by contacting us. Cancellation stops future charges but does not automatically refund charges already paid.
Refunds
Personalized song playlists: you may ask for a full refund within 14 days of purchase, for any reason, by writing to hello@tototherabbit.com. Other purchases: except where required by law or stated at purchase, payments are non-refundable once we begin creating or deliver personalized content. If you were charged by mistake or more than once, or if we cannot deliver the service you purchased, contact hello@tototherabbit.com within 14 days of the charge. We will review the request and, when appropriate, refund the affected payment to the original payment method. Nothing in this policy limits any mandatory consumer rights that apply to you.
Toto Story Club subscription (iPhone app)
Story Club is an annual subscription. The price is shown in the app before you buy and is set by Apple for your country and currency (US$49 per year in the United States). Eligible new subscribers get a 3-day free trial. Payment is charged to your Apple Account. The subscription renews automatically each year unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your iPhone Settings → your name → Subscriptions; cancelling keeps access until the end of the period you paid for. Refunds for iPhone app purchases are handled by Apple under Apple’s policies.
What the iPhone subscription includes
A personalized first story after your subscription or trial starts, and a new story each week. Stories stay in your library. Listening requires an active subscription; if it ends, your stories remain and listening returns when you renew. Stories are streamed and are not available offline. Use “Restore purchases” in the app to reconnect a subscription on the same Apple Account to the Toto account that bought it. A subscription belongs to one Toto account and cannot be moved to a different one.
Personalized content
Stories are written by automated tools, reviewed automatically for serious safety issues, and narrated by a synthetic voice. If something in a story seems wrong, open the story and use “Something wrong? Tell us”, and we will review it. The app is for adults to use with their children. You are responsible for the child details you provide.
Acceptable use
You may not misuse Toto, interfere with its operation or security, attempt unauthorized access, use automated tools to extract content or data, submit unlawful or harmful material, impersonate another person, or use the service in a way that infringes anyone’s rights or violates applicable law.
Third-party services
Toto may rely on or link to third-party services. Those services are governed by their own terms and policies, and we are not responsible for third-party services we do not control.
Disclaimers
To the fullest extent permitted by law, Toto is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee any particular developmental, behavioral, educational, or other outcome from using the stories.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of Toto. Our total liability for any claim relating to Toto will not exceed the amount you paid us for the service during the 12 months before the claim. These limits do not apply where the law does not allow them.
Suspension and termination
You may stop using Toto at any time. We may suspend or end access if you violate these terms, create risk or harm, or if we discontinue the service. Provisions that by their nature should continue—including ownership, disclaimers, and liability limits—will survive termination.
Governing law
These terms are governed by the laws that apply where the Toto the Rabbit operator is established, without limiting any mandatory consumer protections available to you. Courts with jurisdiction under those laws may resolve disputes that cannot be settled informally.
Changes to these terms
We may update these terms as Toto develops. We will post the updated version here and change the effective date above. If a change is material, we will provide additional notice when reasonably possible. Your continued use after the updated terms take effect means you accept them.
